Terms of Service

Welcome to CurbCraze (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the CurbCraze mobile application (the “App”), our website at curbcraze.co (the “Site”), the Owner Hub merchant interface, and related ordering and discovery services (collectively, the “Services”).

By creating an account, accessing the Services, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Services. Our Privacy Policy explains how we collect and use personal information and is incorporated by reference.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services. If you use the Services on behalf of a business (for example, a food truck operator), you represent that you have authority to bind that business to these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly at legal@curbcraze.co if you suspect unauthorized access.

3. The Services

A. Fans / Customers

CurbCraze helps you discover food trucks, browse menus and schedules, follow favorites, and—where enabled by a participating truck—place Order Ahead / pickup orders. Truck locations, hours, menus, and availability are provided by operators and may change without notice.

B. Owners / Merchants

The Owner Hub lets verified operators claim or create truck listings, manage profile content, menus, schedules, locations, and (when Stripe is connected) accept in-app orders. You are solely responsible for the accuracy of your listing, food safety and licensing compliance, pricing, taxes where applicable, fulfillment of orders, and customer service for your truck.

C. Platform role

CurbCraze is a technology platform. Except where we expressly state otherwise, we are not the seller of food or the operator of any food truck. Orders and payments for participating trucks are processed through third-party payment providers (such as Stripe). We do not guarantee that any truck will appear, remain listed, accept orders, or meet any particular standard of quality.

We may suspend or terminate access, remove content, or decline claims/listings that violate these Terms or create risk for users or the platform.

5. Content and Intellectual Property

CurbCraze and its licensors own the Services, branding, software, and related intellectual property. You retain ownership of content you submit (menus, photos, descriptions, logos). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote that content in connection with operating and marketing the Services. You represent that you have all rights needed to grant this license.

6. Payments, Fees, and Refunds

Customer payments for Order Ahead are processed by Stripe or similar processors under their terms. Owner Stripe Connect accounts are governed by Stripe's agreements with you. Platform or service fees (if any) will be disclosed in the Owner Hub or at checkout. Refunds for food orders are handled according to the truck's policies and applicable payment-provider rules; CurbCraze may facilitate refunds through the Owner Hub where enabled but is not obligated to issue refunds from its own funds.

7. Communications

By creating an account, you consent to receive service-related emails and in-app messages (for example, order updates, security alerts, and account notices). Marketing emails or promotional SMS are optional and require separate consent where required by law. You can adjust notification preferences in the App or Owner Hub, or follow opt-out instructions in the message.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT TRUCK INFORMATION OR ORDERS WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURBCRAZE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CURBCRAZE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless CurbCraze and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your content, your truck operations or food products, your violation of these Terms, or your violation of any law or third-party right.

11. Termination

You may stop using the Services at any time and may request account deletion as described in our Privacy Policy. We may suspend or terminate your access at any time if we believe you have violated these Terms, created risk, or if we discontinue the Services. Provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnification) will survive termination.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the Services.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply. Courts located in Georgia will have exclusive jurisdiction over disputes arising from these Terms, subject to applicable law.
